Introduction

These General Terms and Conditions of Sale (GTC) are an agreement between RAPPAZ Sasu (referred to as “RAPPAZ”) and any individual purchasing products on the RAPPAZ website (https://rappazstudio.com, referred to as the “Site”). These terms apply only to non-traders. By placing an order, the Customer accepts the GTC in full.

The GTC can be accessed at any time on the Site and will take precedence over any other document. RAPPAZ reserves the right to modify them, but the version in effect at the time of the order will apply.

1. Purpose

These GTC define the terms of distance selling between RAPPAZ and the Customer, including order, payment, and delivery details.

2. Orders

Orders are accepted based on product availability. If an item is unavailable, RAPPAZ will inform the Customer by email. Orders are processed only after payment confirmation, and RAPPAZ reserves the right to cancel or refuse orders in case of disputes over previous payments. For hygiene reasons, earrings cannot be returned or exchanged. Clothing has a 30-day return policy.

3. Prices

Prices are in euros, including taxes, but exclude delivery and packaging fees, which are displayed in the order summary. RAPPAZ may change prices but will honor the price at the time of order placement. Payment must be made in full at checkout via a secure payment gateway.

4. Delivery

Products are delivered to the address specified during the order. Delivery is available within mainland France, the EU, and Switzerland. RAPPAZ is not liable for delivery delays and cannot offer compensation for such delays. Delivery details are sent by email upon dispatch.

5. Right of Withdrawal

The Customer has 14 days from the receipt of goods to exercise their right of withdrawal. Returns must be in perfect condition, with all accessories, original packaging, and proof of purchase. The Customer is responsible for return shipping costs. Refunds will be processed after verifying the returned items.

6. Non-Conformity and Hidden Defects

All products sold on the Site are covered by legal warranties for conformity and hidden defects. Customers can return defective items free of charge. Any product damage due to improper care is not covered by this warranty.

7. Intellectual Property

All content on the Site, including logos, images, and brands, is the property of RAPPAZ or its partners and cannot be reproduced without permission.

8. Personal Data

In accordance with the General Data Protection Regulation (GDPR) of April 27, 2016, RAPPAZ, as the data controller, informs its Customers that their personal data is collected and processed for the purposes of managing orders, delivering products, and sending newsletters for marketing purposes (with the Customer’s prior consent).

The personal data that may be collected includes: name, surname, billing and delivery addresses, email address, phone number, clothing size, and payment details for processing orders. RAPPAZ is committed to treating this data confidentially and securely.

Order-related data is kept until the completion of the order (including the return period, if applicable). Data collected for marketing purposes (newsletter subscription) is retained for a maximum of three (3) years from the last contact with the Customer.

The Customer has the right to access, rectify, delete, and transfer their personal data, as well as the right to restrict or object to its processing, in accordance with current legislation. The Customer can also unsubscribe from the newsletter at any time by clicking on the unsubscribe link included in every email or by emailing the above address.

RAPPAZ undertakes not to share its Customers’ personal data with third parties without their consent, except where required by law or necessary to fulfill the services (such as for order delivery).

9. Signature and Proof

Entering payment information and confirming an order constitutes proof of the Customer’s acceptance of the order and payment obligation. Electronic records will serve as proof of transactions between the parties.

10. Governing Law

The GTC are governed by French law. In case of a dispute, the relevant court will be that of the Customer’s residence or delivery location. Customers can also seek free mediation through a consumer mediator or the European Online Dispute Resolution platform.
